Welcome to Borrow Nearby. By downloading, accessing, or using our mobile application or web services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
🤝 Community Pledge: Borrow Nearby connects local neighbors to share everyday items. Treat borrowed items with utmost care, verify item condition during handover, return items on time, and communicate respectfully with your neighbors.
1. Eligibility and User Accounts
To use Borrow Nearby, you must be at least 18 years of age and capable of entering into legally binding contracts. You agree to provide accurate, current, and complete information during registration and keep your account information up to date.
2. Item Listings and Lending Rules
- Ownership: You may only list items that you legally own and are entitled to rent or share.
- Prohibited Items: Listing firearms, hazardous materials, counterfeit goods, illegal substances, or stolen property is strictly forbidden and will result in immediate termination and referral to law enforcement.
- Accurate Descriptions: You must accurately represent the condition, functionality, and safety requirements of your listed items.
3. Borrowing Responsibilities & Security Deposits
- Inspection & Dual OTP: Borrowers and lenders must inspect the item condition at handover and verify the 4-digit security code in the app.
- Duty of Care: Borrowers are responsible for maintaining items in the same condition as received, reasonable wear and tear excepted.
- Timely Return: Items must be returned by the agreed booking end time. Late returns may incur daily rental charges and late penalty fees.
- Security Deposits: Refundable deposits are held in escrow and released automatically upon successful return confirmation.
4. Payments and Escrow Protection
All rental payments and security deposits are processed securely through certified payment gateways. Borrow Nearby holds funds in escrow until the borrower confirms receipt and condition of the item.
5. Disputes and Damage Claims
In the rare event of damage or non-return, either party may raise a dispute within the app within 24 hours of scheduled return with photographic evidence. Borrow Nearby reserves the right to arbitrate dispute claims based on uploaded handover evidence.
6. Account Termination
You may terminate your account at any time via the app or through our Account Deletion Page. We reserve the right to suspend or terminate accounts that violate these terms.
